By placing an order with MyTipi (trading as MyCanopy) (“we”, “us”, “our”), you agree to the following terms.

OWNERSHIP & COPYRIGHT

All images, designs, content, and materials remain the intellectual property of MyTipi and may not be reproduced, copied, or used without prior written permission.

PRODUCTS

All canopies are handmade to order. Lead times vary depending on workload and materials availability. Estimated delivery times will be confirmed at the time of order but are not guaranteed.

Canopies are outdoor fabric structures and are not permanent buildings. They are designed to be durable; however, they cannot be guaranteed against all weather conditions.

Care, maintenance, and safety guidance will be provided. You agree to follow this guidance at all times.

SAFETY & RESPONSIBILITY

The safe siting, installation, use, and ongoing maintenance of the canopy is the client’s responsibility once installed.

We are not liable for damage, loss, or deterioration caused by:

• misuse or neglect
• failure to follow guidance
• weather conditions
• third-party actions
• improper or unauthorised installation

If using firepits, stoves, heaters, or other heat sources beneath a canopy, the client must ensure appropriate ventilation and safety precautions are in place. A carbon monoxide alarm is strongly recommended.

PAYMENT TERMS

A 50% non-refundable deposit is required before production begins.

The remaining balance must be paid in full before delivery, collection, or installation.

Payments may be made via bank transfer, cheque, or another agreed method.

DELIVERY & INSTALLATION

Delivery and installation dates will be agreed in advance but are estimates only and not guaranteed.

Delays may occur due to circumstances beyond our control, including weather, supplier delays, or access issues.

Where installation is agreed, the client must ensure:

• safe and suitable access to the site
• adequate working space
• assistance if reasonably required

Installation support is advisory only. Ongoing safety, maintenance, and site suitability remain the client’s responsibility.

SITE PREPARATION & GROUND CONDITIONS

The client is responsible for ensuring the installation area is suitable, accessible, and safe prior to delivery or installation.

This includes confirming that the ground is appropriate for excavation using standard installation methods and is free from underground obstructions, including but not limited to:

• water, gas, electrical, or telecommunications services
• drainage systems or irrigation pipes
• foundations or buried structures
• tree roots or hard ground conditions

The client must ensure all underground services are identified and clearly marked before installation.

MyTipi accepts no liability for damage to any underground services or obstructions that were not disclosed, identified, or marked by the client prior to installation.

If unsuitable conditions are encountered that prevent standard installation, additional labour, specialist equipment, or alternative installation methods may be required. Any resulting costs will be chargeable to the client.

The client agrees to indemnify MyTipi against any loss, damage, claims, or costs arising from inaccurate site information or failure to disclose underground services or site conditions.

CANCELLATIONS & REFUNDS

As canopies are bespoke, made-to-order items, they are non-refundable once production has begun.

Deposits are non-refundable in all circumstances.

Orders may only be cancelled prior to production starting, at our discretion.

LIABILITY

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded under UK law.

Subject to this, MyTipi shall not be liable for any indirect, consequential, or financial loss, including loss of profits, business interruption, or loss of use.

We are not responsible for damage, injury, or loss arising from:

• misuse or improper installation
• failure to follow care or safety guidance
• weather conditions
• third-party actions
• unsuitable ground conditions or undisclosed underground services

The client is responsible for ensuring appropriate insurance cover where required (for example public liability insurance for schools or group use).

FORCE MAJEURE

We shall not be liable for any delay or failure to perform our obligations where this is caused by circumstances beyond our reasonable control, including but not limited to:

• extreme weather
• supply shortages
• transport disruption
• illness
• industrial action
• acts of third parties

GOVERNING LAW

These terms are governed by the laws of England and Wales.

Any disputes shall fall under the exclusive jurisdiction of the courts of England and Wales.
